MagMutual vs The Doctors Company
Both are physician-owned malpractice specialists rated A; TDC is larger and bought ProAssurance, MagMutual is independent with online quote and bind.
Verdict
MagMutual and The Doctors Company are the two physician-founded malpractice carriers that a medical practice is most likely to see side by side. Both write almost nothing outside healthcare. The Doctors Company ranked No. 56 among U.S. business insurers by 2025 commercial lines direct premiums written, at $1.55 billion (NAIC), and No. 2 in medical professional liability. MagMutual ranked No. 95 at $677.2 million, all of it medical professional liability, which makes it No. 4 in that line.
Structure and scale differ. TDC is a policyholder-owned reciprocal exchange managed by an attorney-in-fact, with admitted, risk retention group and surplus lines paper, and it completed its purchase of ProAssurance on June 26, 2026. It now reports about $12 billion of assets and more than $2.5 billion of direct written premium combined. MagMutual is a mutual owned through MAG Mutual Holding Company, with a Southeast home market, regional hubs in New Jersey and the Mid-East, and no pending merger. It remains independent while its largest rival consolidates.
Ratings are matched on AM Best's letter: A (Excellent) for both. TDC's outlook went positive on October 2, 2025, and Fitch affirmed it at A (Strong) in July 2026; MagMutual's rating is A (Excellent) as of October 2026. The tie-breakers are local claims experience, specialty, forms and price, which turn on your specialty, state and claims history, so get both quotes.
Choose MagMutual if
- You are a physician or group in the Southeast or one of its acquired-company regions, and want a regional mutual's underwriters.
- You want to quote and bind malpractice online, with immediate coverage if eligible.
- You value the built-in consent-to-settle provision, automatic locum tenens cover and a free retirement tail after one year with MagMutual and age 50.
- A hospital or health system is exploring captive or alternative risk structures, through its Capital Solutions team or the OURCell cell captive.
Choose The Doctors Company if
- You want the larger national carrier with admitted, risk retention group and E&S paper in one group.
- You are a dentist, advanced practice clinician, long-term care operator or life sciences company, not only a physician.
- MediGuard, which covers licensing board and Medicare/Medicaid proceedings inside the policy, is a priority.
- You like a retirement benefit: free tail for qualified members, and the Tribute Plan for members 55 or older after five continuous years.
- A private equity or MSO-acquired practice needs guidance; TDC issued quoting guidelines in June 2026.

Before choosing, confirm how prior acts are handled. Most policies are claims-made, so you need nose coverage from the new carrier or tail from the old one. Compare consent-to-settle wording, defense costs inside or outside limits, and what the retirement benefits require you to stay for. Property, auto and other practice coverage must be placed elsewhere with either.
